RERA and Your Rights
RERA, the Real Estate (Regulation and Development) Act, 2016, protects people who buy property from builders in India. In Rajasthan, the Rajasthan Real Estate Regulatory Authority looks after it. This page sets out your main rights and duties under the Act, with the section each one comes from, and how the projects on our site fit into it.

The Real Estate (Regulation and Development) Act, 2016 is India’s law for the sale of plots, flats and buildings by builders. It came into force in two steps. The parts that set up the authorities began on 1 May 2016. The parts on registering projects, builders’ duties and buyers’ rights (sections 3 to 19) began on 1 May 2017, and Rajasthan issued its rules under the Act on the same day. The Rajasthan Real Estate Regulatory Authority looks after the Act in the state.
In a planning area, which is an area the government has marked for planned development, a builder must register a project with the Authority before advertising, booking or selling anything in it (section 3). The law covers homes and commercial property. Three kinds of project are exempt: very small projects, projects that received their completion certificate before the Act began, and repair or redevelopment work with no new sale. In Rajasthan, the Authority treats a project as very small only when both limits are met: the land is 500 square metres or less, and there are eight apartments or fewer, counting every phase.
To register, the builder files the project’s approvals, its sanctioned plans, a declaration of title to the land and the time by which the project will be completed. The builder must also put 70% of the money collected from buyers into a separate bank account, to be used only for that project’s land and construction (section 4).
Every registered project gets a registration number, and the builder must show it, with the address of the Authority’s website, on every advertisement (sections 5 and 11(2)). You can check any project’s registration on the Authority’s website:

These are rights against the builder, and they come from the Act. As a buyer you have the right to:
- See the sanctioned plans, the layout plans and the specifications approved by the authorities. The builder must make them available when you book. (sections 11(3) and 19(1))
- Know the stage-by-stage schedule for completing the project, including water, sanitation and electricity. (section 19(2))
- Have a written, registered agreement for sale before the builder takes more than 10% of the price of your home. (section 13)
- Have your home built as per the sanctioned plans. The builder cannot change the plan or specifications of your home without your consent given beforehand, except for minor changes the Act allows, which you must be told about. The builder cannot change the plans of the building or its common areas without the written consent, given beforehand, of at least two-thirds of the buyers in that building. (section 14(1) and (2))
- Claim possession of your home as per the completion time the builder declared when registering the project. (section 19(3))
- Choose, if the builder does not give possession by the date in your agreement for sale. You can leave the project and get back the amount you paid with interest, and also claim compensation. Or you can stay in the project and receive interest for every month of delay until you are given possession. (sections 18(1) and 19(4))
- Be compensated by the builder if you paid an advance relying on an advertisement, prospectus or model home that said something untrue, and you suffered loss because of it. You may also leave the project and get back everything you paid, with interest and compensation. (section 12)
- Keep your allotment. The builder can cancel it only as your agreement for sale allows. If the builder cancels it in any other way, on its own and without good reason, you can ask the Authority for relief. (section 11(5))
- Have a say before the project is handed to another builder. That needs the written consent, given beforehand, of two-thirds of the buyers and the written approval of the Authority. (section 15)
- Have any structural defect, or any defect in workmanship, quality or services, put right free of charge within thirty days, if you tell the builder about it within five years of taking possession. If the builder does not, you are entitled to compensation. (section 14(3))
- Be compensated for loss caused by a defect in the title of the land the project stands on. No time limit bars this claim. (section 18(2))
- Receive a registered conveyance deed for your home and, after you are given possession, the necessary documents and plans. Where no local law sets another period, the deed must be completed within three months of the occupancy certificate. (sections 17 and 19(5))
- Have an association of buyers. The builder must enable one, and where no local law applies it must be formed within three months of a majority of buyers having booked. (section 11(4)(e))
In Rajasthan, the interest in these cases is the State Bank of India’s highest marginal cost of lending rate plus 2% (rule 17 of the Rajasthan rules). The same rate applies to interest a buyer owes for paying late.
Your Duties as a Buyer Under RERA
The same section of the Act also asks some things of you:
- Once you have signed an agreement for sale, pay the builder on time as it says, along with your share of registration charges, taxes, water and electricity charges, maintenance and other charges. (section 19(6))
- Pay interest on any payment you make late. You and the builder may agree to reduce this. (section 19(7) and (8))
- Take part in forming the association of buyers. (section 19(9))
- Take possession of your home within two months of the occupancy certificate. (section 19(10))
- Take part in registering the conveyance deed of your home. (section 19(11))
Our Commitments
A RERA number on every listing
Every project we list carries its Rajasthan RERA registration number, shown on the project page, so you can check it yourself on the Rajasthan RERA website at rera.rajasthan.gov.in before you book.
You book directly with the builder
Each buyer books their own home directly with the builder, and the agreement for sale is between that buyer and the builder. Your booking is counted in the group once the builder confirms it.
We never hold your money
You pay the builder directly. We do not take booking amounts, deposits or any part of the price, and you pay the builder nothing until you decide to book. Under section 4(2)(l)(D) of the Act, the builder must put 70% of the money collected from buyers into a separate bank account, to be used only for that project's land and construction.
Your price, agreed in person
Discounts shown on the site are ranges, not quotes. Your final price and any offers are agreed with you in person. When you book, the price you agreed is written into the builder's booking receipt and agreement for sale.
Is GroupBuyProperty.com Registered with RERA?
Not yet. GroupBuyProperty.com is a website that introduces buyers to the builders of RERA-registered projects. We are starting our application to register with the Rajasthan Real Estate Regulatory Authority as a real estate agent.
Every project we list carries its own Rajasthan RERA registration number, shown on its listing, which you can check on the Rajasthan RERA website at rera.rajasthan.gov.in.
How to Raise a RERA Complaint
If a builder does not do what RERA requires, you can file a complaint with the Rajasthan Real Estate Regulatory Authority, or with its adjudicating officer when you are claiming compensation (sections 31 and 71). You can also complain to the Authority about a real estate agent. A complaint can be filed on the Authority’s website, rera.rajasthan.gov.in, with the fee the Rajasthan rules set.
If you do not agree with the decision, you can appeal to the Real Estate Appellate Tribunal within 60 days of receiving the order (section 44). The Rajasthan tribunal counts the 60 days from the day the order is put on the Authority’s website, so please do not wait for a paper copy.

A note on this page
Last checked: September 2026
We have checked this page with care against the text of the Act and the Rajasthan rules, most recently in September 2026. It is a short summary, so it cannot cover every condition and exception in the law.
Even so, we may have missed something, and laws and rules do change. So please also read the section named beside each point, or ask your own advocate, before you act on it. This page is general information, not legal advice, and your own case may be different.
Where this page and the law, or your agreement with the builder, say different things, please go by the law and your agreement.
